MSA SERVICES INC provides services (defined below) subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you. By accessing and using this website or services, you accept and agree to be bound by these terms. In addition, if you choose to use any materials with references to MyServiceAnimal.org (regardless of their source, i.e., either made by you or purchased from a third party), use any of the materials we sell or provide on our website (including, but not limited to, identification cards, certificates, patches, animal tags, etc.), or refer to MyServiceAnimal.org in any way online or offline, these terms and conditions apply.

MYSERVICEANIMAL.ORG SERVICES TERMS AND CONDITIONS

Our Responsibility and Rules of Conduct:

Our purpose is to create a platform through which individuals can register Service Animals, Emotional Support, and Therapy Animals in an accessible, secure public database and purchase valuable products to identify such animals to the public and make the utilization of such animals easier and more convenient for their handlers.

Additionally, we may refer customers to a licensed doctor or mental health professional in their state for the purpose of undergoing an evaluation by that mental health professional in accordance with the standard of care applicable to that professional. MyServiceAnimal does not direct or control in any way the manner in which the doctor’s mental health professional conducts the evaluation or the outcome of that evaluation. The manner, scope, and outcome of the evaluation are determined solely by the doctor or mental health professional.

Finally, you may purchase a service dog training on your own.

User’s Responsibility and Rules of Conduct:

Registration is conducted under the honor system, and any individual found to violate these rules will be expelled from the registry. The registry is not intended to be a certification process, and we do not judge the proficiency of our registrants in any way, nor would that be necessary under the law. We do not investigate the training or abilities of any animal that is registered through our platform and do not provide any warranties concerning the abilities or training of such animals. We are not responsible or liable for the actions of any animal registered through our platform or utilizing any of the products sold through our website.

In addition, where it is necessary that the handler of an animal registered through our platform is required to have a disability that necessitates the need for a Service Animal, we do not investigate the nature of the disability or require the user to disclose this disability.

However, users certify by registering a Service Animal that the animal the user registering is an animal that has been individually trained to do work or perform tasks for the benefit of an individual with a disability. Users further certify that the work or task that the Service Animal has been trained to provide is directly related to the individual’s disability. By registering an Emotional Support/Assistance Animal, users certify that the animal they are registering is an animal that works, provides assistance, or performs tasks for the benefit of a person with a disability, or provides emotional support that alleviates one or more identified symptoms or effects of a person’s disability for a person who has a disability-related need for such support.

Our services provide no protection above or beyond the law. We are a tool that provides pet online profile services. All data that is used is based solely on the assertions of the provider or Registrant themselves.

You understand and agree that MyServiceAnimal.org services are provided “AS-IS” and that we assume no responsibility for the timeliness, deletion, miss-delivery, or failure to store any user communications or personalization settings. You are responsible for obtaining access to MyServiceAnimal.org services, and that access may involve third-party fees (such as Internet service provider or airtime charges). You are responsible for those fees, including those fees associated with the display

  • Client’s Registration Obligations

In consideration of your use of MyServiceAnimal.org Services, you represent that you are of legal age to form a binding contract and are not a person barred from receiving MyServiceAnimal Services under the laws of the United States or other applicable jurisdictions. That means all MyServiceAnimal.org registrants must conform fully to the current law, meaning that you or the Registrant are the legal and rightful owner and user of a Service Animal and/or Emotional Support Animal/Therapy Animal as described by any applicable law. It is the responsibility of the registrants and users to understand and obey the law online and offline.

You also agree to (a) provide true, accurate, current, and complete information about yourself as prompted by MyServiceAnimal.org Service’s registration form (the “Registration Data”) and (b) maintain and promptly update the Registration Data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or MyServiceAnimal.org has the right to suspend or terminate your account and refuse any and all current or future use of our Services (or any portion thereof).

  • Order Refusal

We reserve the right to refuse any customer’s order without providing any explanation or reasons. This includes, but is not limited to, situations where we suspect fraudulent activity, violation of our terms and conditions, or any other circumstances deemed necessary for order refusal.

SERVICE DOG AGREEMENT

The Service Dog Agreement is a binding agreement between the registrant and MyServiceAnimal, acknowledging the voluntary registration of their Service Dog into the MyServiceAnimal registry. By completing this form, the registrant is agreeing to obtain identification materials to help others identify their Service Dogs. The registrant also certifies that their Service Dog has been trained to assist them with their disability and that they are not registering for fraudulent misrepresentation of a Service Animal. The registrant understands that their dog must meet legal requirements in order for their registration and identification materials to be valid and to receive privileges, including access to housing and public places with a Service Animal.

The registrant also acknowledges that federal and local laws regarding Service Dogs are subject to change and agrees to abide by all current regulations. In case of any access or privilege issues arising, the registrant holds USA Service Dog Registration and its agents and partners harmless, and understands that MyServiceAnimal cannot provide any guarantees that landlords or other third parties will be compliant and non-discriminatory with access and privileges protected by laws regarding service animals.

EMOTIONAL SUPPORT ANIMAL AGREEMENT

Emotional Support Animal (ESA) Agreement: I acknowledge that my completion of this form is to voluntarily register my Emotional Support Animal with the MyServiceAnimal registry. Doing so will provide me with identification materials to help others identify my Emotional Support Animal. Furthermore, I certify that I must possess a signed letter from a licensed Mental Health Professional or Physician to have an Emotional Support Animal, which must be renewed annually. I am not registering for fraudulent misrepresentation of an Emotional Support Animal, and I understand that my animal must meet the legal requirements for registration and identification materials to be valid and to receive the privileges, including access to housing. Additionally, I understand that federal and local law regarding Emotional Support Animals are subject to change in the future, and I will continue to abide by all current regulations. Should any access or privilege issues arise, I hold MyServiceAnimal and its agents harmless and understand that MyServiceAnimal cannot provide any guarantees that landlords or any other third parties will be compliant and non-discriminatory with access and privileges protected by laws regarding Emotional Support Animals.

 

User’s Responsibility and Rules of Conduct:

By registering with us, you acknowledge that you are doing so under the honor system and agree to abide by the rules and regulations set forth by the MyServiceAnimal registry. Violation of these rules may result in expulsion from the registry. Please note that our registry is not intended to certify the proficiency or abilities of our registrants or their animals in any way.

We do not investigate or verify the training or abilities of any animal registered through our platform, nor do we provide any warranties or guarantees concerning their abilities or training. As such, we are not responsible or liable for the actions of any animal registered through our platform or for any products sold through our website.

It is important to note that our services do not provide any additional protection above or beyond the law. We are simply a tool to help individuals register their Service Animals, Assistance Animals, and Therapy Animals. All information provided is based solely on the assertions of the provider or registrant themselves.

We reserve the right to remove any individual from the registry at any time if we determine that they are violating any laws applicable to Service Animals, Assistance Animals, Therapy Animals, and/or our terms of service. Additionally, if an individual or their animal is involved in any act of aggression or violence towards a person, another animal, or property, their registration with us will be considered invalid and possibly fraudulent from the moment it was created.

We believe that Service Animal, Assistance Animal, and Therapy Animal teams must behave in an exemplary fashion at all times, and we may not be held liable in any way for the actions of our members or their animals either online or offline, as they are 100% responsible for themselves at all times.

As a user of MyServiceAnimal Registration Services from MSA SERVICES INC, you agree not to engage in the following activities::

  1. Misrepresent any animal as a Service Animal, Assistance Animal, Emotional Support Animal, and/or Therapy Animal for any reason, whether personal, public or private, online or offline. Misrepresenting an animal as a Service Animal, Assistance Animal, and/or Therapy Animal may be punishable by incarceration, and fines including, but not limited to, other local or federal laws.
  2. Intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, the United States Department of Justice Americans with Disabilities Act (ADA).
  3. Upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
  4. Harm any individual, company, entity, or animal in any way.
  5. Impersonate any person or entity, including, but not limited to, a USServiceAnimals.org official, employee, or volunteer, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  6. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through MySerivceAnimal Service.
  7. Upload, post, email, transmit, or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements).
  8. Upload, post, email, transmit, or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights (“Rights”) of any party.
  9. Upload, post, email, transmit, or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware, or telecommunications equipment.
  10. Intentionally or unintentionally violate any applicable local, state, national, or international law, including, but not limited to, regulations promulgated by the U.S. Department of Justice, or any other entities or agencies having the force of law.
